The theory of legislation in Islamic thought faces the fundamental question of what place popular will occupies in the legislative process if the sovereignty of Sharia determines the binding normative framework of society. This question becomes a complex issue within the model of religious democracy, which emphasizes both the determining role of the people in public affairs and the authority of Sharia. Adopting an analytical approach and seeking to reconstruct the theoretical relationship between Sharia and popular will in the legislative process, the present study distinguishes between two levels of “normative validity” and “legislative process.” It demonstrates that Sharia determines normative validity and the limits of legislative authority, while the “legislative process” constitutes the mechanism for determining, selecting, and institutionalizing specific rules within the legal framework. The most significant contribution of the study is the formulation of the multifaceted role of popular will in the legislative process: epistemic participation in identifying the issue and subject matter; decision-making participation in determining and selecting a social rule within the sphere permitted by Sharia; and institutional participation in formulating and institutionalizing a binding rule. Accordingly, popular will is not an independent source of normative validity; rather, it is regarded as an influential element in determining a specific rule within the framework of the sovereignty of Sharia. This distinction makes it possible to reconcile the sovereignty of Sharia with the real role of the people in lawmaking.
