چکیده
جابجایی اجباری و گسترده جمعیت در نوار غزه، فاجعه‌ای انسانی با ابعاد حقوقی، اخلاقی و فلسفی عمیق است. این مقاله این پدیده را از دو منظر اصلی بررسی می‌کند: اول، تحلیل حقوقی آن در چارچوب جنایت علیه بشریت بر اساس اساسنامه رم دیوان کیفری بین‌المللی (ICC) و قواعد و مقررات بین‌المللی بشردوستانه. در این بخش، به تفصیل به تحلیل عناصر حقوقی جرم، از جمله اجبار، نظام‌مندی و گستردگی، در مورد اقدامات انجام‌شده در غزه پرداخته می‌شود. دوم، تحلیل فلسفی آن با تمرکز بر مفاهیم اخلاقی بنیادین، مسئولیت اخلاقی فردی و جمعی، و به ویژه، نظریه تکلیف‌گرایی ایمانوئل کانت و وظیفه اخلاقی جامعه بین‌الملل. این تحلیل، با تکیه بر گزارش‌های نهادهای بین‌المللی و آرای حقوقی، شواهد لازم برای پیگیری این جنایات را برجسته می‌سازد و اهمیت پرداختن به آن از هر دو منظر را یادآور می‌شود.

The widespread and forced displacement of the population in the Gaza Strip is a humanitarian catastrophe with profound legal, ethical, and philosophical dimensions. This article examines this phenomenon from two main perspectives. First, it provides a legal analysis within the framework of a crime against humanity, based on the Rome Statute of the International Criminal Court (ICC) and international humanitarian law. This section will meticulously analyze the legal elements of the crime, including coercion, systematicity, and scale, as they relate to the actions carried out in Gaza. Second, it offers a philosophical analysis focusing on fundamental moral concepts, individual and collective moral responsibility, and, in particular, Immanuel Kant's theory of deontology and the moral duty of the international community. Drawing on reports from international bodies and legal opinions, this analysis highlights the necessary evidence for prosecuting these crimes and underscores the importance of addressing the issue from both perspectives.Abstract
