The question of the possibility and basis for criminalizing the failure to render aid to others is one of the fundamental challenges at the intersection of ethics and criminal law. Can an individual be deemed worthy of punishment simply for refusing to help in situations where such help does not entail significant risk or considerable cost? Considering the rise of individualism and the erosion of social ties in modern societies, examining such a question holds particular importance. This article, based on a utilitarian-consequentialist viewpoint and by examining pro and con arguments on the subject, concludes that criminalizing the failure to render aid as a legal duty is ethically unwarranted and in conflict with the limiting principles of criminal law. Although refraining from helping others can be morally blameworthy, making aid a legal obligation not only undermines the moral value of such an act, which stems from its free choice, but also weakens individuals' moral will in the long run.
