Adherence to the principle of “rule of law” in relation to the law of promoting administrative health and fighting corruption

Abstract

One of the factors that hinders the development of countries is corruption and lack of health in the government structure, So one of the issues that has been considered as a challenge is the health of administrative system. The efforts of government, especially the Islamic Council, have been aimed at providing the basis for fighting corruption and improving administrative health by enacting various laws. One of the important legal principles that should be considered in this context is the principle of "rule of law". In this regard, the parliament passed the law on improving administrative health and fighting corruption. The present article, emphasizing the principle of the rule of law, which includes the three components of legality, equality and judicial independence, was carried out with the aim of expressing some aspects of the law to promote the health of the administrative system and fight against corruption, and to apply it to achieve a comprehensive and complete law, to fill the existing gaps and finally, a comprehensive and effective law should be approved. In this article, the question has been answered that to what extent the legislator has paid attention to the rule of law in order to promote administrative health and fight against corruption. How is the law on improving the health of the administrative system and dealing with corruption from the point of view of the rule of law? This is a descriptive-analytical study, in which we used the method of collecting information and examining documents in the form of library. The findings indicate that the components of “rule of law” have been considered to some extent, but there are problems that need to be addressed. Finally, the article has suggested solutions to solve these gaps.
