concluding a contract is a voluntary act and requires perception, and human is the only being who has the ability to perceive and conclude it; But recently there have been advances in intelligent systems that, like a human being, can enter into a contract. Now the main question is whether the perceptual tools of intelligent agent can have functions similar to the functions of human perceptual tools in concluding a contract? The purpose of writing this article, which is written descriptively-analytically using library resources: is to compare and match the potential and actual perceptual capabilities of artificial intelligence with human capabilities in terms of concluding a contract to examine the hypothesis of attributing the contract to intelligent agent. The findings of the present study show that concluding a contract is not limited to human capabilities and artificial intelligence by improving its capabilities can have the same functions of human in concluding a contract; As a result, it can be argued that by enhancing the capabilities of artificial intelligence, artificial agent will no longer be tools to convey the will of individuals, But just like a human being, there will be the ability to attribute the contract to them.
